Better Mediate Partners are accredited mediators, having trained with the UK’s premier mediation institutions. We have extensive experience of mediating a wide range of disputes. This experience is further bolstered by our individual experience of working as dispute resolution lawyers in private practice.
What is Mediation
Mediation is a confidential and creative way to resolve disputes. It is fast, cost effective and does not prejudice ongoing or future court proceedings. As mediators we are always impartial. Our role is to listen and give the parties the opportunity to see things differently. In doing so, we help unlock conflict. Mediation is a voluntary process.
Where a party may be unsure about mediation, we can help them decide whether it is right for them. We will also help facilitate an agreement on the appropriate time and place for the mediation and who should attend. Parties in a mediation often attend the session with their advisers and clear advice as to the strengths and weaknesses of their position.
Invariably, that position will include a firm stance. We listen to everyone attentively and explore the issues in the round. Our work is to replacing confrontation and positional arguments with creative thinking and principled negotiation.
How does Mediation work?
The Mediation process can begin once each party has agreed to the confidentiality of the process. Often, the day then starts with a joint meeting of the parties to the dispute. This process is not set in stone however and your mediator will listen to any concerns you may have in this regard.
The goal is achieved when the parties decide to enter into a binding and confidential settlement agreement. Between these two points, your mediator will guide you through series of confidential meetings to explore potential areas of common ground.
Where appropriate, we may recommend additional joint meetings and lay the groundwork for these to be constructive and forward-looking.
